Aura Australia Holdings Pty Ltd (ACN 614 139 589) and its related bodies corporate and related entities (Aura Holdings, we or us) is committed to complying with all relevant privacy legislation and to work within established principles of transparency and fairness in relation to the management of personal information. Aura Holdings abides by the Australian Privacy Principles (APP), as set out in the Privacy Act 1988 (Cth) (Privacy Act).

 Aura Holdings recognises the importance of protecting personal information, for which it may be required to collect from individuals who become associated with its business activities.

The business will guide employees in the responsible collection and handling of personal information, whilst giving individuals the right to access information about themselves and allow for any correction in relation to errors in that information.

For the purpose of this Policy, “information” is described as:

“Personal information” which means personal information as defined by the Privacy Act, including information relating to an individual, including an opinion, either in material form or not, and whether true or not. Such information may personally identify an individual or make the person’s identity reasonably apparent.

“Sensitive information” means information or an opinion about an individual’s racial or ethnic origin, political opinions, membership of political associations, religious beliefs, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual practices, criminal record or health information.

This policy applies to our collection, storage, use and disclosure of personal information collected by Aura Holdings in the furtherance of our business.

What kinds of personal information do we collect? 

The types of personal information we may collect include, but are not limited to:

  • your name, date of birth and address (eg PO boxes, home and work addresses);
  • your contact telephone and mobile numbers, fax numbers and email addresses;
  • personal information volunteered by you in any correspondence between Aura Holdings, its’ representatives and you;
  • personal information volunteered by you when you interact with us on social media;
  • information collected from background or police checks. The Privacy Act imposes more onerous obligations on us regarding the handling of your sensitive information. We willonly collect your sensitive information if you have expressly consented to us doing so, or we are otherwise required or authorised by law to do so; and
  • health
If you are a resident or guest of one of our village communities, we may also collect:
  • your name, date of birth, contact, identification and credit details contained in your application for residency with us, and otherwise as you update and disclose to us from time to time for the management of your residency;
  • your name and contact information in the case that you are visiting a current resident for personal reasons;
  • contact and identification details of any third party you have authorised to negotiate or provide your personal information on your behalf (including any family members, legal advisers, or attorneys appointed by you under a power of attorney);
  • your banking or payment details (for example, for payment of services or site fees);
  • with your consent: health information which may include details of any illness, injury or disability you may have and any treatment or medication that you are receiving;
  • contact numbers for your next of kin and emergency contact, in the case of an emergency; and
  • any personal information you volunteer to us in the process of corresponding with us in respect of your residence or onsite visit, including in responding to your requests and enquiries.
If you are a visitor to our website: 
  • where you submit an enquiry via the website: your contact details (such as your name and phone number or email address), and any personal information you volunteer to us in the process of submitting your enquiry, including, if relevant, details of any previous contact or transaction you have made with us; and
  • we may collect information other than personal information in connection with your visit to our website, including the time and date of your visit, any information or documentation that you download, your IP address, your browser type, domain names, referring website address and internet protocol details of the device used to access the site and cookies.
If you are an employee, contractor, business partner, service provider, job applicant or visitor on our site in the performance of a service for us or any of our residents, we may also collect:
  • personal information provided when you commence or seek to commence employment or enter into a business relationship with us, including your name, contact and identifying information, work history, personal information contained in any trade or employment reference provided to us, and details of your education and qualifications, as may be required depending on the nature of the engagement;
  • banking, tax and superannuation funds details (including your tax file number and ABN if applicable);
  • personal information obtained from background screening providers (including credit checks) before you commence employment or enter into a business relationship with us;
  • with your consent: health information including details of any allergies or dietary requirements you have or other medical conditions which you consider important for us to be aware of; and
  • with your consent: criminal record information obtained through our screening processes before you commence, or during the course of your employment or business relationship with
How do we collect personal information?

In general, we try to only collect your personal information from you directly, but in some circumstances that is not possible or practical. We may collect your personal information:

  • directly from you, such as when you correspond with us in writing (such as by letters and emails), request information or contact us through our website or by telephone, provide your business card or other documents to us (such as application forms) or meet with us in person;
  • from third parties we deal within the course of our business, such as your relatives, your powers of attorney, our professional advisers, contracted service providers, health care providers or any other organisation with whom we do business; and
  • from third party websites we may advertise on, or via contact forms posted on, for example, realestate.com.au, seniorshousingonline.com.au,
  • if you provide us with personal information about another person, you should ensure that you are authorised to do so and direct that person to this
Why do we collect, hold, use and disclose your personal information?

We may collect, hold, use and disclose your personal information to provide you with the services and information you request, and in the administration and management of our business. If you do not provide us with the information we request, we may be unable to provide you with a service or maintain a relationship with you.

In particular, we may collect, hold, use and disclose your personal information for the purposes of:

  • processing your application for residency, as applicable;
  • keeping track of any visitors to our residents, as applicable;
  • managing and maintaining our village communities and our business;
  • maintaining and updating our records, where required;
  • providing access to our website;
  • conducting marketing activities, where relevant to your engagement with us;
  • any other purpose which relates to or arises out of requests made by you;
  • responding to any complaint you have raised with us;
  • doing anything which you authorise or consent to us doing; and
  • taking any action we are required or authorised by law to
If you are an employee, contractor, business partner, service provider, job applicant or visitor on our site in the performance of a service for us or any of our residents, we also collect, hold, use and disclose your personal information for the purposes of: 
  • assessing your application for employment or engagement by us; and
  • furthering your association with us, whether that is as an employee of Aura Holdings or otherwise, including to use or disclose for a purpose connected with your employment or engagement with us; and

To whom we disclose your personal information

Depending on the nature of your relationship with us, we may disclose your personal information to:

  • our employees and contractors engaged in our business, and our service providers who assist us in the administration and management of our business, for example our IT service providers;
  • our related bodies corporate and other entities within the Aura Holdings group;
  • to any third party in connection with the purchase of our business or an asset of our business;
  • health care professionals or other individuals (such as family members or carers), with your consent or where required or authorised by law;
  • your representatives, for example, lawyer or attorney, as authorised by you;
  • our business partners and service providers, for example, IT and administrative service providers;
  • our professional advisers, such as insurers, accountants, auditors and lawyers;
  • government and regulatory authorities, including taxation authorities or the police, where required or authorised by law to disclose your personal information;
  • social media sites and organisations (such as Facebook and LinkedIn) and other virtual communities and networks where people create, share or exchange information, where relevant to your interactions with us on those platforms;
  • publicly on marketing material, where relevant to a testimonial you provide for our marketing activities; and
  • other third parties, with your consent or as detailed on a collection notice (either express or implied).
Overseas disclosure

From time to time, we may disclose your personal information to entities outside of Australia, including our service providers, or other companies with whom Aura Holdings has a business relationship. These entities are located, or store data, in countries including (but not limited to) the United States of America and Ireland.

By submitting your personal information to Aura Holdings, you expressly agree and consent to the disclosure, transfer, storing or processing of your personal information outside of Australia. In providing this consent, you understand and acknowledge that countries outside Australia do not always have the same privacy protection obligations as Australia in relation to personal information.  However, we will take steps to ensure that your information is used by third parties securely and in accordance with the terms of this Privacy Policy.

The Privacy Act requires us to take such steps as are reasonable in the circumstances to ensure that any recipients of your personal information outside of Australia do not breach the APPs. By providing your consent, under the Privacy Act we are not required to take such steps as may be reasonable in the circumstances. However, despite this, we acknowledge the importance of protecting personal information and have taken reasonable steps to ensure that any overseas entity to whom we disclose your personal information is carefully chosen and has policies, procedures and systems in place to ensure your personal information is otherwise handled in accordance with the Privacy Act.

If you do not agree to the disclosure of your personal information outside Australia by Aura Holdings, you should (after being informed of the cross border disclosure) tell us that you do not consent. To do this, either elect not to submit the personal information to Aura Holdings after being reasonably informed in a collection notification, or please contact us via the details set out at the bottom of this document.

We may hold your personal information in many ways including in physical documents as well as in electronic form. The security of your personal information is important to us and we will take reasonable steps to protect your personal information from misuse, interference and loss, and from unauthorised access, modification and disclosure. We will take reasonable steps to destroy or de-identify personal information where we no longer require the information, or we are no longer required by law to retain that information.

Access and correction of information

In general, you may request access to the information that we hold about you at any time by either contacting your village manager (if you are a resident or guest) or by using our details provided below. We will respond to your request for access within a reasonable time. If we refuse to give you access to any personal information, we will provide you with reasons for our refusal and the relevant provisions of the Privacy Act we rely on to refuse access.

We may recover the reasonable costs of our response to a request for access to personal information.

We take reasonable steps to make sure that the information that we collect, use or disclose is accurate, complete, up-to-date, relevant and not misleading. However, if you believe your information is incorrect, incomplete or not current, you can request that we update this information by contacting your village manager (if you a resident or guest) or by using our details provided below. Wewill respond within a reasonable period after the request is made. If we decide not to correct your personal information, we will provide you with reasons for our decision. You may request that we associate with the information a statement that the information is inaccurate, out-of-date, incomplete, irrelevant or misleading.

We will acknowledge receipt of your complaint and endeavour to provide a response within a reasonable timeframe.
